March 16th
I attended court today over the issue whether or not I violated the restraining order that the court issued against me almost two years ago. In attendance were Ruben, Susan Mike McConville as well as their attorney, Jeff Radding. (I wonder if in attorney-client privilege if he has come to learn where Kristin's body is located.)
Anyway - I was represented by LA attorney Okorie Okorocha. The Smarts and I very deeply appreciate everything Okorie is doing for us. Here is a guy who is doing the right thing for the right reasons.
Before court, I showed Okorie the Cal Poly campus as well as the house where Kristin unfortunately met Paul Flores.
The judge issued a court date for trial on April 22nd and that is where both sides will lay out their argument and th judge will render his decision.
The judge also set March 30th as a hearing date regarding the restraining order I filed last week on Ruben, Susan and McConville because of them following me all the while claiming they are afraid of me.
March 15th
I am in the process of moving to Arroyo Grande and going through all that that entails in the moving process. It will place my right in AG, which is where we believe Kristin may be buried. We don't know for sure, of course, but Susan Flores' backyard is sure one of the leading theories.
Tomorrow morning at 9:00am I have a court date with the wonderful 'Ward and June Cleaver' regarding their claim that I violated a restraining order a few years ago. I will let you know haow that goes tomorrow.
March 12th,
I took the day off today which actually felt a bit weird because a pert of me was feeling that I should be doing something for Kristin or Kristen Modaferri. I had the day off from work anyway and had planned on meeting with someone in Arroyo Grande who had a room for rent.
In the end, that offer fell through and the woman felt badly about it - but I really understand her decision. The Flores family are under a lot of pressure and the woman didn't want those issues at this time.

I feel pretty confident about two things: First, Ruben Flores is a lot dumber then the public thinks he is and conversly, Lt. Steve Bolts is a lot smarter then the Flores think he is.
Something is going on. I can feel it. I don't know what it is - but something is going on.
The pie chart to the right is literally true. One of the reasons why I have been able to do this as long as I have is that from the very beginning, I never it was important that I know the details. All I ever really focused on was whether or not LE was trying. I have come to learn that they are trying - but with very limited resources or manpower. It is like they have been given orders to build a skyscraper but have only been given 3 workers, a hammer and two screwdrivers.
Recently the Smarts received an email from the Sheriff's office that was written in a way that was intentionally vague but also worded in such a way as to communicate to the Smarts that Kristin was anything but forgotten.
That is all I am going to say about it because of the Flores. They read this website probably more than anyone.
One of the things that I am most hopeful about is the December court decision by the judge to delay a critical decision on the pending civil trial. In his decision, the judge stated that he has seen the work that the SLO Sheriff department has been doing and he felt optimistic about what he saw.
That is powerful.
March 11th
I made a trip to the San Luis Obispo courthouse today and filed papers seeking a restraining order against Ruben Flores, Susan Flores and Mike McConville. I was told the judge will get the papers most probably on Monday and then they will be mailed to Okorie Okorocha, my attorney.
I did not include Paul in the request beacuse I only had proof of Ruben, Susan and McConville assaulting or harassing me.
Below is text of an email sent to me by an attorney representing Mission Hills Mortgage - which claims that Mike McConville was fired for harassing me.
Mr. Mahon,
The following is a message I posted on the guest book for the Son of
Susanwebsite on September 27, 2002. If you are responsible for maintaining
thatwebsite, could you please remove all references to my client, Mission
HillsMortgage. If you are not responsible for maintenance, please forward
thismessage to the person who is or let me know who that person is so I can
contact them.

The loss of Kristin Smart is a horrible tragedy. My heart goes out to her
parents and friends. Whoever is responsible for her disappearance must
be brought to justice. While I sympathize with the frustration you feel in
resolving this crime, I have a request.
I am a lawyer and I represent Mission Hills Mortgage. Your website mentions
Mission Hills several times, implying Mission Hills had something to do
with Kristin's disappearance or at least is hampering investigations into
it.
Nothing could be further from the truth.
Mike McConville is no longer affiliated with Mission Hills in any way.
Any telephone calls from Mission Hills' office he placed to Dennis Mahon or
anyone else associated with the investigation of Kristin Smart's
disappearance were unauthorized and contrary to company policy.
He has been terminated.
Please remove any reference to Mission Hills Mortgage from your website. It
has no connection to the Kristen Smart matter. There is no reason to
continue to damage its reputation.

March 10th
Today is the 3 year anniversary of Kent Jacobs disappearance from his hometown of Hope Mills, NC. The pain these families go through begins with the loss of a loved one and then quickly spreads to saturate every aspect of their lives. Here is Kent's story.
The Flores are once again trying to have the website shut down. They will do everything on earth possible to get rid of me except for what the easiest thing there is to do - and that is to very simply 'cooperate with the SLO Sheriff's department.

Catherine Crier has a new book out today and it is an extremely detailed account of the entire Scott Peterson case. The tome is incredibly sourced and her contacts are impeccable because no way on earth does anyone get all the police documents that she has been able to get otherwise.
She talks briefly about Scott's possible connection with Kristin Smart but there was nothing really substantial along those lines. She incorrectly spells Kristin as 'Kristen' - but that is a common mistake. From just browsing through the pages - the book seems to be pretty amazing. It will easily go down as the authoritative book on this sad case.
A nice woman pulled alongside of me as I was walking near the Starbucks on S. Broadway today. She had a small child with her so she just parked her car and we talked for about 20 minutes. Her name is Kelly and she went to Cal Poly at the same time as Kristin.
She told me a story about Kristin which I have since shared with Denise Smart, Kristin's mom.
There was a party at the college and the word was put out that it had a luau as its theme. A bunch of girls wanted to go but no one had any flowery Hawaiian shirts. Everyone knew of Kristin's love of Hawaii so one day they all raided her closet and borrowed her shirts for the party.
Kristin vanished before the girls had the chance to return the shirts and to this day - the girls still have Kristin's shirts and Kelly said it was a really had an impact on everyone.
Kelly could not have been more supportive of our efforts to find Kristin and she made sure I knew that she was going to follow this website from now on.
Finally - I was leaving the courthouse and was walking past a small business when I suddenly heard a voice calling out to me. It was Ruben Ramos and his son Albert who run a Christian mission called 'Word From The Rib'. He got pretty emotional and kept saying to me 'they need to get that guy - they need to get that guy!" Ruben gladly posed for this photo you see on the right. There are many people like him in Santa Maria, Ca.
March 9th
I was at the Santa Maria courthouse for the Jackson trial again. I met with a local media guy named William who was in the courtroom today and really follows this stuff closely. He told me that the Judge is probably going to dismiss this case because they are catching the witnesses in lie after lie. Enough of that.
I got to met a woman from Munich, Germany by the name of Evelyn Popp. She handcrafted this Michael Jackson marionette and she really caught the eye of the media coz everyone was interviewing her. Her goal is, of course, to meet Jackson and present it to him.
I also got a chance to meet with Ted Rowlands who is a reporter for CNN. If his name sounds familiar - it is because he used to be a reporter in the Modesto, Ca area and became nationally known for his reporting during the Chandra Levy case as well as Scott Peterson.
I was pleasantly surprised on how knowledgeable he was on the smaller facts of Kristin's case and was really impressed to learn that he knew about Kristen Modafferi as well.
I then spent about twenty minutes walking him through pretty much everything I knew and we agreed that I would email him all the appropriate documents relating to both Kristen Mod and Kristin Smart.
Ted didn't promise anything in the way of coverage - but I was glad to see that he cared and hopefully - sometime in the near future - a national story will result.
March 8th
Paul Flores was employed at the Union 76 station in Arroyo Grande when Kristin vanished. I spoke with an employee there today and he was so disinterested in being cooperative that I honestly did not get his name. I asked if there were any 'old timers' still working there and he happened to be at the register.
As soon as I mentioned Kristin Smart and asked if he had heard any talk about her case, his body language and tone of voice were doing nothing but telling me to get lost.
In a sarcastic voice, he said, "Look, no one hear discusses Kristin's case and no one who worked here before aver discussed Kristin's case" He followed that up by saying this if the boss ever catches anyone talking about Kristin Smart, that person will be fired. He then barked out his bosses number so I went ahead and published it here.
Needless to say - Five Cities residents may want to buy their gas elsewhere.
He said that the boss was Mr. Miller - I think it is Cevin MIller - but I am unsure of the spelling.
I report this because I want the reader to get a little taste of what has been fed to the Smarts all these years. Things are twisted - it is almost like people are so content on just burying her memory. "Don't rock the status quo", is pretty much the consensus.

I received this email Tuesday evening, March 9th. My reponse is below

Mr. Miller,
Thankyou for responding. I will take you up on your offer and I will call you.
'Unfortunately back then I had not overheard anything or did not have any special knowledge that could help the distressed family.'
If that is true, and I believe you, than that is the first we heard of it. I understand you when you say you already talked to the police and told them you didn't know anything. If you have not spoken with them since 2002 - then you are missing something bigtime. More on that later. Just so you know, Lt. Steve Bolts of the San Luis Obispo Sheriff's office met with me and made it very clear that he could not and would not, share anything with me about the case because of how sensitive the investigation is. Fair enough - I have never had a problem with that. Eight years later in a courtroom before a judge, Det. Steve Crawford told the judge that his department allocates between 2-3 hours per month on Kristin's case. If you do the math - that comes down to between 4-6 minutes a day. The LE in this community is so understaffed and underfunded that very worthy cases like Kristin's do not get the attention LE would like to put into it - or that Kristin deserves. Therefore - it is up to Kristin's family and friends to keep the fires burning, so to speak. I personally believe that Lt. Bolts is in a near impossible situation. The Flores have told his office to 'get lost' (5th Amendment) and he doesn't have near the manpower or funding he would like. That is why I walked into your station. I may not be an Police Officer, but I am in the position to contribute more than 4-6 minutes a day. Law Enforcement communities nationwide rely on the public's help to solve cases. (Just look at the Elizabeth Smart case in Utah)
Now you come into my business and ask an employee who was 13 years old at the time of Kristin's disappearance and aggressively ask him questions.
If he was 13 at the time, that would make him about 22 yrs old now. That means he was 13 about 3,230 days ago. Coincidently, that is the exact number of days that Kristin's lifeless body has been laying in the ground somewhere. Kristin has earned the right to have these questions asked. He may have been 13 back then - but he is a grown man now and politely asking him if any old-timers were still working there is not a question that should damage a grown man's feelings. As far as being aggressive - my behavior was, and always is, very polite. If he told you otherwise - he is lying to you. I was polite, but I will admit that I did ask questions. If that makes him, or you, feel uncomfortable - then I guess that make you and him uncomfortable. But Kristin still deserves to have these questions asked.
"I have no gag order with the guys."
That is 180 degrees opposite what your employee said. His actually words were, "if the bossman catches anyone talking about Kristin - they are fired". I understand that you say that is not a gag order - but whatever name you attach to that statement - it seems to me to be pretty close to a gag order. More importantly - three years ago I went to your station in Pismo to basically ask the same question, one of your employees nearly took my head off - he was 20 times more rude that what I met with yesterday. So, Union 76 has set a pattern of being rude and 100% uncaring towards Kristin. At some point, Mr. Miller - we all have our 'threshold points' and yesterday - your employee tripped that wire. That is why I posted it online. It was a combination of yesterday and three years ago. (Kristin has been missing over 3,200 days). Now think for a moment how Mr. and Mrs. Smart have to fight themselves to sleep each night not knowing where Kristin is buried - only to have that topped off with some very rude employees at Union 76? That get's old.

You can be of assistance. Are you aware that perhaps the single biggest lead we have received in this entire case came to us from one of your employees?
He called LE with this information way back in 1996 - and no one ever called him back. Six years later, in 2002, when Kristin was declared legally deceased - this employee became so disgusted that he contacted the Smarts atty and eventually I drove to his home and met with him.
(Have you spoken with LE since 2002?)
He says that Paul confided with yet another one of your employees that Kristin died in his (Paul's) dorm room and that with the help of yet another one of your employees - he hid Kristin's body in the Nipomo Mesa. Now - I believe you 100% Mr. Miller, when you say you don't know anything - but clearly something was happening amongst your employees regarding Kristin's case and if I have to say this one million times more, I am willing to do so:
KRISTIN DESERVES TO HAVE THESE QUESTIONS ASKED!
If your employee from three years ago wasn't so 'off the wall' rude followed up by a repeat performance yesterday - then none of this webposting would have been necessary.
